The terms, conditions and limitation of liability under which the tour operates are detailed hereunder and the payment of the deposit or tour price represents acceptance by the purchaser of the following:-

 

  1. The Tour is organised by the Canterbury Horticultural Society Inc. (hereinafter called “the CHS).
  2. The CHS is not responsible for any failure on the part of our service providers such as airlines, coach operators, gardens or hotels.
  3. The CHS reserves the right to alter or change the accommodation, carriers or coaches at any time for any reason. The CHS reserves the right to cancel or alter the itinerary for any reason whatsoever including, but not limited to, road, weather or traffic conditions, non-performance of suppliers, industrial action, operational conditions and requirements. All additional expenses incurred as a result of any delays, cancellations or alterations will be the sole responsibility of the passenger.
  4. A minimum number of bookings are required to operate a tour and also to ensure an enjoyable small group atmosphere. Where sufficient numbers cannot be achieved, the CHS reserves the right to cancel the tour.
  5. Where a tour is cancelled prior to departure, according to clause 4 above, a refund less administration and cancellation fees will apply.
  6. Any special passenger requirements must be notified to the CHS at the time of booking. No passenger will be permitted to embark or continue on the tour while their mental or physical condition is in opinion of the representative of the CHS , such as to render them incapable of caring for themselves, or whereby they become objectionable to other passengers, or they become a hazard to themselves or other passengers. The CHS will not be responsible for expenses resulting in such persons being precluded from completing the tour for any such reason.
  7. The CHS can give no guarantee as to the exact arrival and departure times for carriers and operators used by the CHS in the tour. The CHS will not be liable for failure to make connections with any other services and/or missed tour inclusions.
  8. The CHS reserves the right to cancel any ticket or booking or to refuse to carry any passenger where the CHS has not received payments within the times specified for the tour.
  9. The CHS reserves the right to vary the price advertised or printed to cover any significant increase in the airfare, fuel price, exchange rate, or other tour related tariffs and costs. Passengers are reminded that this is a condition of travel.
  10. The CHS shall not be liable for any loss, damage or injury occasioned to any person or property as a result of any inclusion or action undertaken during the tour whatsoever or howsoever the same may be caused whether as a result of negligence or otherwise.
  11. Baggage is entirely at ‘owners risk’ during the tour. Passengers are entitled to carry one suitcase per person with the total sum of its length, width and height not exceeding 200cm and weight 20kg.Personal items such as cameras, make-up, medication etc should be carried in a purse or cabin bag. Surcharges will apply for extra/overweight baggage and there is no guarantee that they can be carried.
  12. Travel Insurance: The tour price does not include comprehensive Travel Insurance but the CHS requires travellers to have insurance for all overseas tours to cover any unforeseen circumstances which may arise (including, but not limited to cancellation fees, loss of luggage, medical treatment on tour and early return following death of a relative).
    Insurance for local tours is at the discretion of the traveller.
  13. To ensure all passengers have the opportunity to enjoy front and window seats, a daily seat rotation system is employed.
  14. Where a single passenger is willing to share accommodation with a fellow single passenger, the CHS will endeavour to find another traveller of the same gender. The CHS otherwise accepts no responsibility for the suitability of the rooming partner and it is a condition of travel that single passengers willing to share accommodation accept the rooming partners allocated by the CHS . If a passenger at any time during the tour considers the rooming partner to be unsuitable, the CHS will, subject to availability and at the additional cost of the passenger, arrange single accommodation.
  15. Whilst the CHS will take all reasonable steps to provide an enjoyable tour, the CHS accepts no liability for any loss of enjoyment whatsoever and howsoever experienced by the passenger.
  16. The passenger tickets in use by the airline carrier shall constitute the sole contract between the carrier and the purchaser of these tickets and/or passengers using the tickets.
  17. Tour Payment: A payment schedule will be provided by the CHS .
  18. Cancellation Fees: Cancellations must be advised in writing. Fees will apply from the date of the tour departure. No refunds are available for any services or part of the tour not used. Prior to departure consideration will be given by the CHS for each case to be judged on its merit.
  19. Passport and visas: The CHS will forward all relevant visa information relating to your particular travel arrangements will be forwarded to you at the earliest possible date. If you have been convicted of a crime, sentenced to prison or suffer from mental illness or severe physical handicap you MUST check with each country’s Embassy for special visa requirements. The CHS accepts no responsibility for non-obtained visas under any circumstances.
  20. Frequent Flyer Points: Not all airfares utilised by the CHS quality for airpoints with the applicable carrier for that tour. Where they do, failure by the airline to credit points to the passenger is not the responsibility of the CHS. Retrospective requests for missing points must be dealt with by the passenger to the airline concerned.
